Terms and Conditions

Introduction

These Terms and Conditions ("T&C") govern the use of services provided by CREATORFEED TECHNOLOGIES (hereinafter referred to as "the Company", "We", "Us", or "Our"), with its registered office at Bamburi, Cuttack, Odisha, 754100, India. The T&C apply to (i) "You", "Your", "Yourself", or "User"; and (ii) "End-User" (collectively referred to as "they", "them", or "their") who access or avail the Services offered through Our "Website", "Creatorfeed", or "Platform" (collectively referring to the website https://creatorfeed.in, its linked pages, or application services, including mobile applications or mobile site services).

Electronic Record

This document is an electronic record under the Indian Contract Act, 1872, and the Information Technology Act, 2000, along with applicable rules and regulations (including amendments or re-enactments thereof), and does not require physical, electronic, or digital signatures.

Acceptance of Terms

Please carefully review these T&Cs before using Creatorfeed's services or accessing any material or information on the Platform. By accessing or using the Platform, Users and End-Users signify that they have read, understood, and agree to be legally bound by these T&Cs, including additional terms, conditions, and policies referenced herein or available via hyperlink on the Website.

Your use of the Services constitutes acceptance of these T&Cs from the point of usage. CREATORFEED TECHNOLOGIES reserves the right to update or modify the Services periodically without prior notice. If You do not accept these T&Cs, You may not use the Services. Continued use of the Platform after any updates signifies acceptance of the modified terms.

If You object to these T&Cs or any subsequent modifications, Your sole recourse is to cease using the Platform immediately. Additional terms may apply for specific services availed from time to time.

Contact Consent

By providing Your contact details, You consent to be contacted by Us or Our representatives via any provided contact number, email, or address.

By submitting Personal Information to the Company or consenting to its use for rendering Services, You express interest in availing Creatorfeed's Services in accordance with these T&Cs. CREATORFEED TECHNOLOGIES is not an educational institution, marketplace, or content provider, and Users are neither Our employees nor agents.

Definitions

  • Applicable Law: Any statute, law, regulation, ordinance, rule, judgment, order, decree, approval, directive, guideline, policy, requirement, restriction, decision, determination, or interpretation by any applicable Authority, as amended.

  • Authority: Includes the Government of India, state governments, or any administrative, regulatory, statutory, tax-related, judicial, or quasi-judicial authority in India.

  • Confidential Information: All information disclosed or acquired during the subscription term, including User and End-User lists, business models, processes, product details, and pricing.

  • Content: Software, data, text, audio, video, images, or personal data uploaded, collected, posted, stored, or transmitted through the Platform.

  • End-User: Any person accessing Content on a User's Landing Page.

  • Landing Page: A unique webpage created through Creatorfeed's software where Users host their services and Content.

  • Platform Fee: Fees payable for using the Platform.

  • Service Fee: Subscription fees payable for availing Services.

  • Services: All tools, functionalities, and services offered through the Platform.

Eligibility

Users must be at least 18 years of age and legally competent to enter into binding agreements under Indian law.

Services and User Guidelines

Creatorfeed provides SaaS tools enabling Users to create, host, manage, publish, and sell digital Content through their Landing Pages.

Services are provided on an "as is" and "as available" basis. Creatorfeed shall not be responsible for downtime caused due to force majeure, third-party service failure, maintenance, or User actions.

Creation of Account

Users must create an Account to access Services and provide accurate and complete information.

Users are responsible for safeguarding login credentials and all activity under their Account.

Creatorfeed reserves the right to suspend or terminate Accounts violating laws or these T&Cs.

Fees and Payment Terms

All applicable Service Fees and Platform Fees shall be as per Company policy and communicated on the Website.

Refunds and cancellations shall be governed by the Refund & Cancellation Policy published on the Website.

Warranties

Users warrant that they own or have rights to all Content uploaded and that Content does not violate any Applicable Law or third-party rights.

Creatorfeed makes no guarantees regarding uninterrupted or error-free service.

Indemnification

Users agree to indemnify and hold harmless CREATORFEED TECHNOLOGIES against any claims arising from misuse of Services or violation of these T&Cs.

Intellectual Property Rights Policy

All Platform materials are owned by Creatorfeed or its licensors. Users retain ownership of their Content but grant Creatorfeed a license to host and distribute it.

Waiver

Failure to enforce any provision shall not constitute a waiver of future enforcement.

Limitation of Liability

Creatorfeed shall not be liable for indirect, incidental, or consequential damages. Liability shall not exceed total fees paid by the User.

Disclaimer

Users are responsible for ensuring compliance of their Content with Applicable Law. Creatorfeed is not responsible for User Content.

Confidentiality

All Confidential Information shall be protected and not disclosed without consent, except as required by law.

Reservations of Changes

Creatorfeed may modify these T&Cs and Services at any time. Continued use signifies acceptance.

Termination

Either party may terminate the agreement. Upon termination, User access shall be revoked.

Final Provisions

These T&Cs constitute the entire agreement between the parties.

Governing Law and Jurisdiction

These T&Cs shall be governed by Indian law and subject to the exclusive jurisdiction of courts in Odisha, India.

Force Majeure

Creatorfeed shall not be liable for failure due to circumstances beyond reasonable control.
